What changed
Since Federal Decree-Law No. 33 of 2021 took effect on February 2, 2022, employers can no longer legally block a job transfer by withholding an NOC. The old system, where your current employer's consent was effectively mandatory, is gone.
What actually determines your transfer eligibility now
The Ministry of Human Resources and Emiratisation (MOHRE) now bases job-transfer approval on:
- Serving your notice period properly
- Correctly cancelling your old work permit
- No absconding report or serious-breach flag on your record
None of these require your employer's active consent — they're procedural, not permission-based.
The one catch: contractual clauses
Some employers still write NOC-style clauses into contracts, hoping employees don't realize they're not legally enforceable to block a lawful transfer. If your contract mentions requiring employer consent to switch jobs, know that MOHRE's current framework doesn't require it — the notice-and-clean-record path is what actually governs eligibility.
